
I am Attorney Daniel Lustenberger and I have been licensed to practice law in the State of New Hampshire since 2002. My practice focuses primarily as Defense Attorney and Divorce Lawyer.
I am a goal oriented client focused attorney. I am plain spoken and honest. I will be candid with you about your goals and ways to achieve those goals. I have trial experience in the District Court, Superior Court and Family Division including Juvenile and Abuse and Neglect cases.
I am licensed to practice in the Federal Court for the District of New Hampshire and I have handled several federal criminal matters from violations of supervised release to major drug cases and also DUI cases.
I have had success in each of these Courts. I do not win every trial but I have won my share. I would offer that the likelihood of success usually depends on the facts as they are presented. Sometimes the key point in a case will turn on issues of law, sometimes on the facts of the underlying matter. In either event, whether to go to trial or not is the client’s decision. I can help the client arrive at that decision based on my experience and analysis of the case.
My overall philosophy is to make things less complicated and attempt to give every client the opportunity to be heard and have their day in court if that is their wish.
Prior to becoming licensed to practice in New Hampshire I worked in the Hillsborough County Attorney’s Office as a clerk intern. Following this I was an Assistant County Attorney in Strafford County prosecuting domestic violence cases.
The benefit of this experience to my clientele now as a defense attorney is that I can identify and focus on the issue at hand and quickly develop a strategy to overcome the deficit in either a divorce or criminal matter or both at the same time, which unfortunately occurs often.
I am a graduate of the New Hampshire Police Standards and Training Academy for part time officer certification. I have arrested people for drug possession and DUI. I know how a police officer arrives at his or her reasonable suspicion and probable cause to make an arrest because I have done it. Now what I do, as do all other defense attorneys, is go back and undo it piece by piece bit by bit.
Upon graduation from the University of Maryland in 1993 with a Bachelor’s Degree in Criminal Justice I returned to New England and worked as a youth counselor at New Hampshire’s then existing maximum security unit for juvenile offenders. Thus my basis and experience in juvenile law. I can talk to your minor child at his level and have at least a comprehensive understanding of not only their legal issue but perhaps what lead to the behavior. I am that child’s advocate, his or her confidante, and his or her legal representative.
I have also served in the United States Army for nearly 5 years. Fortunately I was in during a relatively peaceful time period. I was a Cavalry Scout and proud member of the 82nd Airborne Division. I enlisted as a buck private left the service as a Sergeant.
I am a member of the New Hampshire Association of Criminal Defense Lawyers and a Life Member of the Disabled American Veterans. I am also a member of the New Hampshire Bar Association’s committee for the delivery of legal service thorough the Lawyer Referral Service.
My interests include sport fishing and beaches in general. Being from New England I have also had the opportunity to work on a few different commercial fishing boats from Southern Maine to Cape Ann. I understand what it means to earn a wage.
I am a sole practitioner so I have the authority to arrive at our agreement for representation. I don’t need to go to a managing partner for approval on a course of action and neither do you. I’m it.
